Le Costa Rica, État démocratique, bénéficie d'une législation antidiscriminatoire abondante. Pourtant la situation des Afro-Costariciens n'est pas enviable. La société, bien que métissée, s'autodéfinit comme blanche et méprise tout ce qui n'est pas comme elle. Les plus discriminés sont sans doute les Afro-descendants, qui ne sont pas objet d'une législation spécifique comme le sont les peuples autochtones. La législation générale n'est pas adaptée à leurs nécessités et lorsqu'ils s'en servent pour faire valoir leurs droits devant l'administration ou des juridictions, il n'est pas rare que la réaction du fonctionnaire public leur faisant face soit une totale incompréhension. En effet, à aucun stade de l'enseignement primaire, secondaire ou même supérieur, ne sont faites de réelles références à l'existence ou aux apports des Afro-Costariciens à l'élaboration de la Nation costaricienne d'aujourd'hui. Rendus invisibles, ils sont incompris et discriminés et ont du mal à survivre dans la différence qui les définit. Pourtant le Costa Rica aurait tout à gagner à reconnaître son statut pluriethnique. Costa Rica is a democratic State and enjoys an abundant anti discriminatory legislation. However the situation of the afro Costa Ricans is not enviable. However the society is a melting pot, it defines itself as being white and look down on everything and everyone that is not like it. The most discriminated are undoubtedly the afro descendents. In fact, they are not the object of a specific legislation as indigenous people are. The general legislation is not adapted to their needs and when they try to have their rights recognized by the administration or by tribunals, it happens often that the reaction of the civil servant is a real incomprehension. Indeed, at no stage of the education program, primary school, secondary or even superior, is made a real reference to the existence and to the contributions of the Afro Costa Rican to the development of the present Costa Rican Nation. Invisiblized, misunderstood and discriminated, they hardly survive, living the difference that defines them. However Costa Rica would gain to recognize its pluri ethnic statute.
