Créée pour défendre les droits fondamentaux des Allemands au lendemain de l'expérience national-socialiste, la Cour constitutionnelle interfère par ses arrêts dans la politique extérieure allemande. Elle est particulièrement vigilante en matière de construction européenne, d'intervention des troupes à l'extérieur du territoire national et de ratification des principaux traités internationaux. Son intervention vise dans chacun de ces secteurs à protéger les prérogatives du Bundestag, lieu de la légitimité démocratique de la nation allemande. Created to defend the fundamental rights of Germans in the aftermath of the National Socialist experience, the German Constitutional Court interferes with German foreign policy through its judgments. It is particularly vigilant in terms of European construction, the intervention of troops outside the national territory, and the ratification of the main international treaties. Through its interventions in each of these sectors, it aims to protect the prerogatives of the Bundestag as trustee of the democratic legitimacy of the German nation.
