Résumé Alors que dans l'esprit des réformateurs, il s'agissait de créer le cadre institutionnel permettant d'augmenter les capacités de production de l'agriculture en créant des exploitations capitalistes, considérées comme plus productives, la privatisation des terres agricoles est passée par la distribution d'« actifs fonciers » à toutes les personnes liées aux exploitations soviétiques. Nous analyserons la régulation de l'appropriation foncière issue de ce processus de privatisation à partir de textes de loi, d'entretiens conduits auprès d'acteurs du monde agricole dans la région d'Orel, et de la théorie économique des patrimoines collectifs. Celle-ci considère l'existence de rapports conflictuels et complémentaires entre deux formes de relation économique : la première est marchande, la seconde est patrimoniale et vise à la préservation des communautés. Nous verrons alors que la volonté d'aller vers l'économie de marché s'accompagne, paradoxalement, de l'objectif de préserver la place d'une agriculture où le renouvellement générationnel et la sécurité alimentaire sont reconnus.

Résumé anglais The non-market-oriented liberalization and regulation of Russian agriculture's land inheritance (1991-2006) The idea of reform was, in the mind of the reformers, to create an institutional framework geared to increasing agricultural production capacities by setting up capitalist farming concerns, considered to be more productive. However, the privatization of farmland was accomplished by the distribution of “land assets” to all people linked to the soviet farms. The article examines the regulation of access to land tenure resulting from this privatization process. It uses legal texts, records of interviews conducted with people involved in the agricultural world in the Orel region and the economic theory of collective inheritance. This theory considers the existence of conflictual and complementary relations between two forms of economic relationship : the first is commercial, the second is patrimonial and has the objective of preserving communities. It will be seen that the will to go towards the market economy paradoxically goes alongside the objective of preserving the place of an agriculture where generational renewal and food security are recognized.
