La notion d'identité est importante car elle préside aux relations de l'individu avec les droits dont il est reconnu sujet par cette communauté. Pourtant, les dispositions processuelles n'utilisent la notion d'identité qu'avec parcimonie, révélant à travers la mobilisation des éléments qui la composent une conception civiliste de l'identité. Reposant sur des critères choisis, variables, interchangeables et détachables de l'individu, l'identité numérique ne présente pas de vertus d'authentification et son effet d'identification se trouve nuancé. L'identité numérique inclinerait en effet plus vers la traçabilité que vers l'identification qu'elle n'autorise qu'avec le secours d'éléments permettant de la corroborer ou de présomptions posées par les juges. Numerical identity in judicial proceedings Identity is a very important term which represents the principal way of specifying the relationship between a person and the rights one has. However, the way this notion is used in judicial proceedings is to focus on a specific aspect of the idea of identity which is numerical identity is established on criteria that are selected, inconstant, interchangeable and not necessarily linked to the person the numerical identity has to identify. As a result, the numerical identity does not authenticate any one person and does not reliably identify the person who is alleged to be the owner of the identity. In effect, the principal result of numerical identity should be the traceability rather than the identification of an individual which can only be achieved if objective criteria affirm the numerical identity as a valid indication.
