Cet article étudie la mise en conformité au droit européen en Europe centrale et orientale. En nous intéressant à la dimension formelle-légale du processus de mise en conformité, nous avons constaté que les États membres anciennement communistes ont largement réussi à transposer le corps de législation européenne, de façon adéquate et dans les temps impartis, et que cela a perduré après l'adhésion à l'Union européenne. S'intéressant en particulier à l'étape de mise en œuvre pratique, l'article conclut que dans le cadre de trois politiques (communication électronique, protection des consommateurs et bien-être animal), les résultats de l'introduction de celles-ci dans les États postcommunistes présentent des défauts, qui ne dépassent cependant pas la nature et l'échelle des problèmes rencontrés en Europe occidentale. This article reviews the patterns of compliance with EU law in Central and Eastern Europe. Looking at the formal-legal part of the process of compliance, I find that the post-communist member states have been largely successful in transposing the body of EU legislation properly and on-time, and that the success has persisted after the moment of accession to the EU. Focusing on the practical implementation stage, the article concludes that in three different policy sectors (electronic communications, consumer protection, and animal welfare), the implementation performance of the post-communist member states exhibits shortcomings, which are however not of a different nature and not on a different scale than the implementation problems in Western and Southern Europe.
