Cet article porte sur l'importance, les fonctions et la structure pluripartite de l'ICANN, l'institution la plus influente dans la gestion des ressources et des standards Internet au niveau mondial. En effet, depuis sa création, l'ICANN a été l'organisation, dans la nébuleuse des organisations gravitant autour de la gouvernance d'Internet, ayant provoqué les débats les plus controversés entre techniciens, politiques, activistes et académiciens. L'ICANN étant une organisation de droit privé californien, mais avec un mandat mondial, elle n'a pas seulement essuyé les feux de la critique pour son manque de contrôle démocratique et de transparence, mais aussi pour sa relation privilégiée avec le gouvernement américain. Plus récemment, le souhait de certains gouvernements de transférer une partie des fonctions de l'ICANN à une véritable organisation internationale a provoqué une polarisation du débat autour de la gouvernance d'Internet que certains considèrent aujourd'hui comme les premiers signes d'une « Guerre froide numérique». Afin d'expliquer les fonctions de l'ICANN dans l'écologie actuelle de la gouvernance d'Internet, l'article évalue le rôle du département du commerce américain (Department of Commerce), a joué dans l'histoire de l'ICANN tout en analysant les tentatives faites par l'ICANN pour s'adapter aux demandes et aux besoins de ses différents acteurs. This essay aims to discuss the importance, functions and multi-stakeholder structure of ICANN, the most powerful of the institutions responsible for administering resources and standards for the global Internet. Since its inception, ICANN has been the institution in Internet Governance that has provoked the most heated and controversial debates amongst technicians, politicians, activists and academics. As a private organization operating under Californian law, but of global importance, ICANN has not only been criticized for its lack of democracy, accountability and transparency, but also for its privileged relationship with the US government and the limited influence of other countries on its modus operandi. Recently, the wish of some governments to transfer part of ICANN's functions to a truly intergovernmental organization led to a polarization of the debate around Internet Governance that some regard today as the first sign of a “Digital Cold War.” To draw a clearer picture of ICANN's current role in the existing Internet Governance ecology, the essay evaluates the role of the US government and its Department of Commerce in ICANN's history and current situation, and reviews the main points of criticism as well as the various attempts of ICANN to adjust to the demands and needs of its stakeholders.
