L'importante convocation de l'institution judiciaire dans le giron de la politique de la ville et du développement social urbain ne laisse pas d'inquiéter les juristes attachés à l'idée de son « indépendance ». En fait, l'analyse démontre que des processus complexes d'adaptation de l'organisation « Institution judiciaire » sont en œuvre, non seulement au regard des exigences de la rationalité administrative, mais encore au regard de l'évolution des fonctions sociales et politiques du droit. Au-delà de la question de la dilution de l'institution judiciaire dans l'action administrative de l'État, se pose avec acuité la problématique de la modernisation de l'institution judiciaire tout entière sous l'influence des critiques socio-politiques intenses qu'elle subit. The Judicial Institution and Urban Social Development.
The pressing invitation given to the judicial institution to join the fold of urban policy and social urban development has not failed to worry jurists attached to the idea of its « independence ». In fact, analysis shows that complex processes of adaptation of the organization of the « judicial institution » are at work, not only from the standpoint of the demands of administrative rationality, but also from that of the political and social fonctions of law. Beyond the problem of the judicial institution's dilution in the administrative action of the State, lies the question of the modernization of the entire judicial institution under the influence of the intense socio-political criticism aimed at it.
