Le centenaire de l'Inspection du travail nous incite à penser la façon dont le droit est produit à travers sa perception et son application. À la dénonciation initiale de l'illusion d'un droit protecteur a succédé la condamnation sans appel de la figure douteuse de l'inspecteur, fonctionnaire incompétent techniquement, socialement et moralement. La recherche d'une véritable Inspection ouvrière a permis ensuite de rendre l'institution plus légitime. Le rapprochement du syndicalisme et de l'Inspection s'est réalisé à travers les figures successives de l'Inspection ouvrière, de l'Inspection composite et enfin de la syndicalisation des inspecteurs. Cette reconnaissance progressive dissimule quelques invariants qui structurent encore la polémique entre l'État et la CGT mais aussi entre les divers courants syndicalistes de nature idéologique ou professionnelle. Factory Inspectorate and Labour Inspectorate in the CGT's Policy Statement from the Institution's Beginning to the Inter-War Years.
The centenary of the factory inspectorate leads us to think about the way in which the Law is produced through its perception and practice. The initial denunciation by the CGT of an illusory protection Law was followed by the total condemnation of the inspector himself, seen as a technically, socially and morally incompétent official. The ensuing search for a proper labour inspectorate gave the institution greater legitimacy. The drawing together of trade unionism and the factory inspectorate occurred through the successive figures of the labour inspectorate, heterogeneous inspectorate and, finally, the unionization of the inspectors themselves. This gradual recognition hides some constant thèmes which still structure not only the polemic between State and the CGT, but also the different trade unionist trends of an ideological or professional nature.
