Cet article éclaire l'histoire de la « responsabilité des commettants » en traçant un lien entre la tragédie de l'incendie de l'usine Triangle Shirtwaist, à New York en 1911, et le récent drame de l'effondrement du Rana Plaza, au Bangladesh en 2013. Il apparaît ainsi que, dès le sweating system du XIXe siècle, les défenseurs des travailleurs ont pointé du doigt la responsabilité de ceux qui, sans exercer une contrainte directe sur la main-d'œuvre, tirent néanmoins profit de son exploitation. Mais si le problème des mauvaises conditions de travail a alors été principalement réglé par d'autres moyens que la responsabilisation des commettants, la lutte anti-sweatshop dans le cadre des échanges mondialisés se caractérise en revanche aujourd'hui par un recours quasi exclusif à l'exercice d'une pression sur les donneurs d'ordre. This paper sheds lignt on the history of the « responsibility of the principals » by drawing a connection between the tragedy of the Triangle Shirtwaist Factory fire, in New York in 1911, and the recent tragedy of the Rana Plaza collapse, in Bangladesh in 2013. The paper shows that, since the 19th century, when the sweatshop system appeared, the defenders of the workers have pointed a finger at those who profit from their exploitation, though they only exercise indirect control. The paper also emphasizes that, though in other contexts, the issue of poor working conditions sometimes found solutions that avoided holding the principal liable, what characterizes the anti-sweatshop movement in the context of globalization is its nearly exclusive focus on bringing pressure to bear on the contractor at the head of the chain.
