Cet article se rapporte aux fondements et à la signification des notions de droits
humains et de biens publics mondiaux, dans le champ de la santé. Il s'interroge
sur la pertinence respective d'une approche orientée "biens publics santé" ou
axée sur la santé comme "droit humain". Notre objectif est double : d'une part,
souligner l'intérêt d'une approche en termes de droits pour dépasser certaines
limites de l'approche économique des biens publics mondiaux ; d'autre part,
montrer que, malgré les nombreuses déclarations apparemment favorables aux
droits humains, c'est l'approche "biens publics", et avec elle la focalisation sur
les préoccupations économiques, qui prédominent au sein de la gouvernance

Is health a global public good or a human right ? This article analyses the bases and the meaning of the concepts of human rights and global public goods, in the field of health. We wonder about the relevance of two approaches, the first one considers health as a public good, and the second one is a “human rights based” approach. We try to underline the advantages of the second approach and to show that, despite the many declarations in favour of the human rights, the public good approach and the economic priorities are still prevailing in the world governance for health.
