Les audiences françaises et américaines devant les jurés présentent des dispositifs qui produisent deux logiques d'élaboration de la vérité. Alors qu'en France le président dirige les débats pour rechercher la vérité des faits, sur les faits aux États-Unis les représentants des parties s'affrontent pour faire triompher leur propre vérité. Chaque culture judiciaire entretient un rapport singulier aux émotions dans la production des preuves. Si en France les émotions sont suscitées pour faire émerger la vérité, aux États-Unis c'est la recherche de l'émotion la plus convaincante qui domine les débats. Source : Éditeur (via Cairn.info) |

French and American hearings offer two different logics of the elaboration of truth. While in France the President directs the hearing in order to get to the bottom of the truth, in the United States each party's representatives go face to face to ensure that their own truth wins the day. Each judicial culture has a specific relationship with emotions in the production of evidence. Whereas in France emotions are guided and moderated in order to establish the truth, in the United States the hearing is dominated by the quest for the most convincing emotion.
