Les atteintes à l'indépendance de la justice ont pris une forme insidieuse : sous l'empire d'un nouveau management public, des stratégies d'entreprise sont appliquées à la justice, transformant le juge en maillon d'un système de production. Les organisations de magistrats y opposent une résistance, ancrée dans une culture politique et une pensée critique, confortée par la jurisprudence de la Cour européenne des droits de l'homme. Cette résistance a aussi contribué à l'émergence d'une nouvelle diplomatie judiciaire, face à l'internationalisation des enjeux et à la mondialisation du droit. Source : Éditeur (via Cairn.info) |

Interference with the independence of the judiciary has taken an insidious form : in the grip of a new brand of public management, business strategies are being applied to the justice system, turning the judge into a link in a production line. Judges' organisations are resisting this movement, from a standpoint anchored in political culture and critical thinking, backed by the case law of the European Court of Human Rights. This resistance has also contributed to the emergence of a new judicial diplomacy, in the face of the internationalisation of the issues and the globalisation of the law.
