ONU et action humanitaire par Mario Bettati inflation humanitaire pose le problème de élargissement du mandat huma nitaire de ONU pas toujours bien distingué de la mission traditionnelle de maintien de la paix Dans ce domaine le droit international humanitaire qui vise limiter les dégâts causés par la guerre est souvent contré par le droit notamment de souveraineté La communauté internationale est donc tournée vers Assemblée générale et le Conseil de Sécurité pour répondre aux questions que posait action humanitaire internationale sur les plans normatif et opérationnel Sur le plan normatif le principe de libre accès aux victimes est consacré par ONU par la résolution 43/131 du décembre 1988 Sur le plan opérationnel ONU applique ce principe de fa on graduée allant de invitation injonction Lorsque ampleur de la mission humanitaire dépasse ses propres moyens il arrive ONU de sous-traiter une partie de opération avec certains Etats après délibération du Conseil de Sécurité intervention de Organisation vise soit établissement un ordre public humanitaire il peut agir une assistance humanitaire armée ou de la soustraction des victimes leur agresseur) soit au rétablissement un ordre public démocratique Source : Éditeur (via Persée) |

The UN and Humanitarian Action by Mario Bettati Given the increasing importance of the concept of humanitarian action the UN is faced with the problem of enlarging its humanitarian mandate mandate not always clearly distinguishable from its traditional peacekeeping mission In this domain international humanitarian law which aims to limit the damage done by war is often thwarted in particular by the law of sovereignty The international community has turned towards the General Assembly and the Security Council for response to normative and operatio nal questions posed by international humanitarian action on normative level the principle of free access to victims is established by Resolution 43/131 of 8th December 1988 In practice the UN applies this principle by gradually proceeding from invitation to injunction When the scope of humanitarian mission goes beyond its means the UN after deliberation by the Security Council may subcontract part of the operation out to certain states UN intervention aims either to establish humanitarian public order which may demand armed humanitarian assistance or the removal of victims from their aggressor or to reestablish democratic public order Source : Éditeur (via Persée) |
