Résumé Avec l'adoption de la Loi fondamentale (Grundgesetz), le droit allemand a été imprégné par la théorie des droits fondamentaux (Grundrechte) et celle des droits subjectifs (subjektiven Rechte) censées assurer une protection effective des citoyens. Or, en droit allemand, la motivation des actes administratifs ne constitue ni un droit fondamental ni un droit subjectif aménagé au profit des citoyens. Et selon la conception qui prévaut Outre-Rhin, le principe de motivation des actes administratifs a été aménagé, principalement dans la perspective d'une concrétisation matérielle du principe de l'État de droit (Rechtsstaat) et dans celle d'une « bonne administration » (gute Verwaltung). Cette conception irrigue le cadre juridique aménagé en Allemagne.

Résumé anglais With the adoption of the Basic law (Grundgesetz), German law has been imbued with the theory of fundamental rights (Grundrechte) and that of subjective rights (subjektiven Rechte) which were both supposed to provide effective protection for citizens. However, in German law the statement of reasons for administrative acts is neither a fundamental nor a subjective right for citizens. And so, according to the prevailing view in Germany, the principle of stating reasons for administrative decisions has been adjusted, mainly with a view to substantiating the implementation of the rule of law (Rechtsstaat) and that of “good administration” (gute Verwaltung). This conception permeates the developped legal framework in Germany.
