Cet article retrace la première décennie de l'histoire du langage des droits humains au Nicaragua, depuis son émergence à la fin des années 1970. Nous exposons d'abord comment les acteurs nicaraguayens se sont tour à tour saisi de ce vocabulaire, en lui conférant des significations variées. Nous nous intéressons ensuite à ses traductions juridiques et pratiques au lendemain du triomphe sandiniste de juillet 1979. Force est de constater que ces usages des droits humains furent jusqu'alors essentiellement stratégiques. À partir de 1982, l'entrée en guerre de la Contra accentua encore davantage cette instrumentalisation, l'extrême médiatisation du thème jouant à cet égard un rôle fondamental. Dans un dernier développement, nous décrivons le tournant amorcé à partir du milieu des années 1980, à travers la valorisation de schèmes démocratiques, l'intégration du vocabulaire du droit dans les répertoires d'action et la distanciation de divers groupes militants vis-à-vis du Front. Ce basculement progressif sembla finalement marquer l'avènement d'un nouveau paradigme des droits humains au Nicaragua, qui, trois décennies plus tard, demeure néanmoins extrêmement fragile. This article traces the first decade in the history of the language of human rights in Nicaragua, from its emergence in the late 1970s. We begin by describing how Nicaraguan actors have taken up the language, giving it a variety of meanings. We then look at its legal and practical translations in the aftermath of the Sandinista triumph of July 1979. It must be said that this usage of human rights as a tool were until then essentially strategic. From 1982 onwards, the outbreak of war with the Contra's further accentuated this instrumentalization of such, with the extreme media coverage of the subject playing a fundamental role in this respect. In the final section of this article we describe the turnaround that began in the mid-1980s, through the promotion of democratic schemes, the integration of the legal vocabulary into the repertoires of action, and the separation of various militant groups from the Frente Sandinista. This gradual shift seems to finally mark the advent of a new human rights paradigm in Nicaragua, which three decades later remains extremely fragile. Source : Éditeur (via Cairn.info) |
