| Résumé |
Cet article a pour objectif d'observer comment se constitue un monde d'action commun entre chercheurs, industriels et juristes lors de prise de brevets en partant des controverses qui se sont développées autour de la technologie des hybridomes quand celle-ci s 'est propagée dans les activités bio-industrielles. Cinq points de litige sont ainsi étudiés portant sur la définition d'une technique de base, sur la notion d'anticorps identiques, sur ce qu'on entend par une application évidente, sur les personnes qui sont reconnues comme experts, et enfin, sur la part relative des propriétés naturelles et de l'intervention humaine. Les deux auteurs montrent alors que le travail de traduction qui transforme les hybridomes en «invention» est le résultat d'une construction qui articule des éléments scientifiques et des éléments juridiques. Techniques, implements, inventions : changes in a biotechnology
How does a common action arise between researchers, industrialists and legal experts when patents are filed ? This question is investigated by looking at the controversies that have arisen around hybridoma technology in bioindustry. Five issues are studied : the definition of a basic technique, the notion of identical antibodies, the meaning of an obvious application, the persons recognized as experts, and the determination of what is to be set down to natural properties or to human interventions.
