Cet article compare une même affaire dite K traitée par deux arrêts de cour d'assises en 1e instance (sans jurés) et en deuxième instance (avec jurés). Il cherche à comprendre comment ces deux verdicts aboutissent pour le premier à une condamnation pénale et le second à un acquittement. Loin de voir un pur aléa dans ces décisions, cet article rédigé par le président de la cour d'assises d'appel explicite les raisons de ces variations. This article compares the treatment of the same case (the "K case") in two assize court judgments, that of the original trial (held without a jury) and that of the appeal (with a jury). It attempts to explain why these two verdicts differ, the first having led to a criminal conviction and the second to an acquittal. Far from attributing these decisions to the vagaries of chance, this article written by the judge who presided over the appeal explains the reasons for these variations.
