La comparaison interne et internationale en matière d'office du juge a permis un regard à la fois panoramique et spécifique : panoramique sur de grands mouvements à l'œuvre, qui viennent réinterroger l'office des Hautes Juridictions, mais aussi des juges du fond, par exemple face à des causes systémiques mondiales ; spécifique par l'étude de contentieux particuliers (droit des contrats…), dont l'évolution anticipée dans certains pays permet d'imaginer celle que connaîtra la France. Ce regard porté conduit à une vision renouvelée de l'office du juge national qui devrait être plus affirmé dans son existence comme son intensité, et s'inscrire dans un espace ouvert élargi. Internal and international comparisons of the role of the judge have provided a vision that is at once panoramic and specific: panoramic in the sense of an overview of the major movements at work, which are challenging the role of the higher courts, but also that of trial judges, for example in the face of global systemic causes; and specific by the study of particular types of litigation (contract law, for example) whose anticipated development in certain countries gives an idea of the direction it is also likely to take in France. This is leading to a renewed vision of the role of the national judge, which should be more assertive in terms of both its existence and its intensity, whilst being part of a wider, open space.
