Résumé anglais Report by G. Braibant A personal viewpoint on the problems which confront the administrative court judge, based on personal experience and written with the authority of someone who has published works on the subject of administrative law. The fact that the nature (both public and private) of many of these administrative bodies is not clearly defined has several drawbacks in that this makes difficult to ascertain applicable jurisdictional rules, results in a dissimilar legal status for such institutions and threatens to undermine the overall nature of the control traditionally exercised over public administration by the administrative judge. But the author is not content merely to State the facts — in this report he outlines the two main solutions which could be envisaged, i.e. either the adoption of a purely material or organic criterion or, on the other hand, the extension of the administrative judge's control to ail administrative missions irrespective of what organisation Controls them.
