Résumé anglais The US Flag has been the object of a religious cult ever since it was created ; as a result of this, the Supreme Court has been confronted throughout its own history with divers cases of non-reverence to the Flag — sacrileges ranging from a mere rejection of the pledge of allegiance to actual burnings of the national emblem. Unwilling to take the « divinization » of the Flag into account, and sometimes resisting enormous pressures, the Court has consistently refused to « burn the first Amendment » (except, to some extent, in Gobitis, 1940, which anyhow was overturned less than three years after), always giving priority to the freedom of speech principle (including in its symbolic expressions). But it may be asked whether such serenity was not due to the fact that desecrating the Flag has hitherto been the act of isolated individuals, rather than a mass attitude actually jeopardizing public order.
