À partir des réclamations adressées au Défenseur des droits pour « discrimination à raison de l'orientation sexuelle », cet article s'intéresse aux pratiques discursives de présentation de soi des réclamantꞏes, et à l'impact de ces pratiques sur l'instruction des réclamations par les agentꞏes de l'institution. Adossé à des données quantitatives et qualitatives, l'article montre comment les propriétés sociales des réclamantꞏes – en particulier leurs positions de genre et de race – infléchissent le processus judiciaire de reconnaissance de l'homophobie. L'analyse du récit de l'expérience de l'homophobie montre également que la capacité à formaliser discursivement un acte homophobe pour le faire reconnaître par les catégories du droit se situe tendanciellement dans le haut de l'espace social. La judiciarisation de l'homophobie produit ainsi un sujet de droit sexuel idéal-typique, à la croisée des rapports sociaux de classe, de genre et de race. Source : Éditeur (via Cairn.info) |

Based on complaints lodged with the defender of rights for “discrimination on the grounds of sexual orientation”, this article looks at the discourse used by claimants to introduce themselves, and the impact of this discourse on the investigation of complaints by the institution's officers. Using quantitative and qualitative data, the article shows how the social attributes of claimants - in particular their gender and racial positions - influence the judicial process of recognizing homophobia. The analysis of accounts of experiences of homophobia also shows that the ability to discursively formalize a homophobic act with a view to having it recognized under the terms of the law tends to be found among people in higher positions on the social ladder. The judicialization of homophobia thus produces an ideal-typical subject of sexual law, at the crossroads of social relations based on class, gender and race. Source : Éditeur (via Cairn.info) |
