    La ruine des idéologies du xxe siècle a entraîné la renaissance des passions identitaires qui ont engendré un nouveau régime politique, la démocrature. Inventée par Vladimir Poutine en Russie, exportée en Chine ou en Turquie, déclinée sous la forme de la démocratie illibérale en Europe orientale, la démocrature se caractérise par le culte de l'homme fort, le refus de l'État de droit, le contrôle de l'économie et de la société par l'État, une propagande de masse et une répression ciblée. Les démocratures s'opposent frontalement aux démocraties, dont elles exploitent la crise tant sur le plan international que sous la pression intérieure des populismes. Leur percée masque cependant de réelles faiblesses, qui découlent de l'absence de garantie des droits individuels. Le défi que constituent les démocratures érige de nouveau la liberté politique en enjeu central du xxie siècle. La survie de cette dernière, à l'âge de l'histoire universelle, dépendra de la capacité de la démocratie à se réinventer.
    The collapse of 20th century ideologies has led to a renewal of passions for ethnic or national identities, which has produced a new political regime, the democratorship. Invented by Vladimir Poutine in Russia, exported to China or Turkey, taking the form of illiberal democracy in Eastern Europe, the democratorship is characterized by the cult of the strong leader, the refusal of the state of law, the control of the economy and society by the state, mass propaganda and targeted repression. Democratorships frontally oppose democracies, whose crisis they exploit at the international level as well as under the domestic pressure of populist groups. However, their breakthrough masks real weaknesses due to the lack of guarantee of individual freedoms. The challenge represented by democratorships establishes once again political liberty as a central stake for the 21st century. Its survival, in the age of universal history, will depend on the capacity of democracy to reinvent itself.

    Les démocratures désignent des régimes fort différents les uns des autres, qui ont pour point commun de réunir des éléments dictatoriaux et démocratiques. Plusieurs critères permettent d'opérer quelques distinctions au sein de ce vaste domaine : ils touchent à la démocratie électorale (degré de compétitivité des élections, pouvoir effectif des représentants élus) et au libéralisme (garantie des libertés, séparation des pouvoirs, respect du droit).
    The term “democratorship” refers to regimes that are quite different but share a common feature, the bringing together of dictatorial and democratic elements. Several criteria allow to operate a distinction within this vast domain: they concern electoral democracy (degree of competitivity of elections, real power of elected representatives), and liberalism (guarantee of liberties, separation of powers, respect of the law).

    La multiplication des démocratures amène à s'interroger sur leur légitimation constitutionnelle. Non seulement les constitutions des États démocratiques se révèlent incapables de défendre les principes et valeurs qu'elles protègent, mais elles facilitent de surcroît la légitimation des démocratures, qui endossent le cadre constitutionnel en vigueur pour mieux asseoir leur autoritarisme. Essentiellement formelle, la légitimation constitutionnelle des démocratures se fonde sur les faiblesses de la protection constitutionnelle existante et la transforme en instrument de propagande pour renforcer son pouvoir.
    The multiplication of democratorships raises the question of their constitutional legitimation. The constitutions of democratic states are not only proving incapable to defend the principles and values they protect, but they also facilitate the legitimation of democratorships that embrace the existing constitutional framework in order to better establish their authoritarianism. Mainly formal, the constitutional legitimation of democratorships is based on the weaknesses of the existing constitutional protections, which they transform into propaganda tools to reinforce their power.

    Italy is experiencing an unprecedented situation with a government based on an unholy alliance between two populist parties, Matteo Salvini's Lega and Luigi Di Maio's Five Star Movement, which have diverging interests. These parties are trying to invent forms of direct democracy and are contributing to the establishment of a “peoplocracy”.

    La démocratie est-elle le meilleur système de gouvernement concevable ? Cette opinion, largement répandue dans la seconde moitié du xxe siècle, semble aujourd'hui battue en brèche. Les régimes autoritaires ne seraient-ils pas plus efficaces dans la poursuite de leurs objectifs à long terme ? Le climat d'hypercritique en régime libéral ne paralyse-t-il pas les ambitions politiques ? Malgré sa vulnérabilité apparente et en dépit de défauts indiscutables, la démocratie jouit néanmoins d'une plasticité qui lui confère une capacité supérieure d'adaptation aux tendances lourdes des sociétés modernes.
    Is democracy the best conceivable government system? This idea, which was widely shared during the second half of the 20th century, seems to be challenged today. Would authoritarian regimes not be more efficient in the pursuit of their long-term goals? Does not the hypercritical atmosphere that exists under liberal regimes paralyse political ambitions? Despite its apparent vulnerability and undisputable defects, democracy possesses a plasticity that provides it with a superior adaptability to the long-term trends of modern societies.

    Central Europe is making a comeback in the perceptions of the West, but for reasons opposite to those of 1989. It is no longer democratisation, but on the contrary the authoritarian regression called “illiberal democracy” that is focusing attention. Thirty years after the fall of the Berlin Wall, the notion of democratic society is opposed to that of open society. How can we explain such a turnaround? What are its main features and how can we define such hybrid regimes that are moving away from liberal democracy while not embracing dictatorship?

    Since the emergence of the Arab Springs in 2011, the Arab world has been experiencing a deep transformation of its political and social structures. While the complaint of the people has become audible everywhere, the authoritarian regimes intend to resist this new reality and adapt to it. They all have strengthened their power for fear of popular insurrection. The modernisation of the Saoudi regime, which is more autocratic than ever, is thus confronted to the new, opposite model of Tunisia, where democratisation is under way.

    Latin America is currently experiencing severe democratic regressions. The rise to power of progressist governments in the 2000s represented a revitalisation of democracy. However, there is nowadays, among both the old progressist governments and the new conservative ones, a temptation to embrace democratorship in a political climate characterised by major uncertainties.

    La guerre froide a longtemps gelé tout processus démocratique en Afrique, y compris dans les pays où des Africains ont libéré leurs pays, les armes à la main. À la chute du mur de Berlin, le vent démocratique de l'Est a soufflé timidement et tardivement vers le Sud. Dans les années 1990, des conférences nationales souveraines ont semblé ébranler les palais d'autocrates souvent cooptés ou adoubés au pouvoir par les anciennes puissances coloniales. Un leurre. Non seulement les présidents « sortants » ont repris la main, mais les plus anciens au pouvoir ont verrouillé toute alternance en ayant appris à jongler avec des constitutions importées. D'autres ont dû affronter l'opposition de leurs anciens compagnons de route, soutenus par des sociétés civiles de mieux en mieux organisées et informées grâce aux réseaux sociaux. La vraie nouveauté est la montée en puissance d'une jeunesse urbanisée et mondialisée en phase avec des diasporas très politisées.
    The Cold War long blocked any democratic process in Africa, including in countries liberated by African themselves through armed struggle. After the fall of the Berlin Wall, the democratic wind coming from the East blew timidly and belatedly toward the South. In the 1990s, sovereign national conferences seemed to undermine the power of autocrats often co-opted or supported by the former colonial powers. This was an illusion. Not only have the “outgoing” presidents held to power, but those longest in place have blocked any possible alternative by learning to play with imported constitutions. Others have had to confront the opposition of their former fellow travellers supported by civil societies which have become better organised and informed thanks to the social networks. The real novelty is the growing power of an urbanised and globalised youth in line with highly politicised diasporas.

    La nature du régime chinois n'a pas changé depuis 1949, mais la nécessité de renouveler la légitimité du Parti communiste au lendemain de la mort de Mao Zedong a conduit Deng Xiaoping à relâcher la pression de l'appareil sur la société et l'économie. Après le massacre de Tian'anmen, en 1989, Deng a ouvert le pays au marché mondial tout en maintenant la dictature. Le développement économique rapide et l'exploitation des zones grises par les animateurs d'ong ont conduit à un relâchement des contrôles. En arrivant au pouvoir, Xi Jinping a réprimé la société civile émergente et renforcé la direction du Parti dans tous les domaines, éliminant les espaces d'autonomie et instaurant le culte de la personnalité. Hégémonie du Parti sur la société et le gouvernement, culte du chef, nationalisme, la Chine n'est nullement comparable aux « démocratures ». Dictature assumée, son système rappelle de plus en plus le fascisme.
    The nature of the Chinese regime has not changed since 1949, but the need to renew the legitimacy of the Communist Party after the death of Mao Zedong led Deng Xiaoping to release the pressure of the party apparatus on society and the economy. After the 1989 Tian'anmen massacre, Deng opened the country to the world market while maintaining the dictatorship. The rapid economic development and the exploitation of grey areas by ngos have led to a release of controls. After rising to power, Xi Jinping repressed the emerging civil society and reinforced the direction of the Party in all areas, eliminating autonomous spaces and installing the cult of personality. With the hegemony of the Party on society and government, the cult of the leader and nationalism, China cannot be compared to democratorships. As an ostensible dictatorship, its system increasingly recalls fascism.

    La « démocrature », combinaison inédite des procédures formelles de la démocratie représentative avec la démagogie autoritaire, est peut-être une pente sur laquelle nous sommes engagés. Son origine se trouve dans le discrédit des institutions traditionnelles, et dans la perte de confiance à l'égard des gouvernants qui en résulte. Peut-on prendre un autre chemin, notamment en distinguant mieux, dans notre démocratie, la fonction d'incarnation de la nation de la fonction de gouvernement ? Une révision constitutionnelle peut-elle le permettre ? Est-elle seulement possible ?
    As an hitherto unseen combination of the formal procedures of representative democracy and authoritarian demagogy, democratorship might be a slope on which we are engaging. Its origin is to be found in the discredit of traditional institutions and the loss of confidence in governments it has produced. Can we follow a different path, for instance by introducing a clearer distinction between the function of incarnation and the function of government? Could a revision of the Constitution allow it? Would such a distinction even be possible?
