      La négociation collective est marquée, en France et depuis quelques décennies, par une décentralisation en direction du niveau de l'entreprise. L'entreprise elle-même, ces dernières années, a fait l'objet de questionnements sur sa nature et sa qualification juridique, après être longtemps restée occultée derrière la notion de société. Ces deux mouvements suggèrent que l'entreprise est en voie d'institutionnalisation, par la montée en puissance d'un intérêt qui lui serait propre et qui serait l'objet de négociations à ce niveau. Le présent texte vise à examiner cette hypothèse de manière critique, en adoptant le double point de vue du droit du travail et du droit des sociétés. Ce double point de vue sera médiatisé par la notion, centrale ici, d'intérêt.
      In France, collective bargaining has been marked for several decades by a decentralization toward the company level. In recent years, the company itself has been the subject of questions about its nature and legal status, after having long remained hidden behind the notion of the société. These two movements suggest that the company is in the process of being institutionalized, through the rise of an interest of its own which would be the subject of negotiations at this level. The present text aims to examine this hypothesis critically, adopting the dual viewpoint of labor law and company law. This double point of view will be mediated by the notion, central here, of interest.

      L'ordonnancement des accords collectifs de niveaux différents a été en particulier pensé et décrit dans les rapports entre l'entreprise et la branche. Mais le regard peut s'orienter également sur un autre versant et embrasser l'ordonnancement des niveaux que l'on peut qualifier d'organisationnels en ce qu'ils constituent des espaces de négociation propres à l'organisation productive. Dans la détermination des lieux de déploiement de la capacité d'autorégulation et dans l'agencement des normes conventionnelles, se joue alors une certaine construction et structuration de l'organisation productive. À cet égard, le droit positif est le tableau d'une évolution marquante. D'une part, s'esquisse une diversification des niveaux de conclusion des accords collectifs. À l'établissement et à l'entreprise s'est ajouté le groupe, et même le niveau de « l'interentreprises ». D'autre part, cette diversification s'accompagne, non pas d'une répartition matérielle des compétences normatives distribuées entre chaque niveau, mais d'une liberté offerte aux interlocuteurs sociaux de choisir le niveau qu'ils jugent le plus approprié pour leur négociation par la création d'une forme de fongibilité des accords. L'accord collectif d'entreprise devient une catégorie générique englobant l'accord d'établissement, l'accord d'entreprise au sens strict, et l'accord de groupe. Cette liberté va jusqu'à offrir la possibilité aux parties d'organiser la prévalence de l'accord conclu au niveau centralisé sur l'accord de proximité.
      The ordering of collective agreements at different levels has generally been thought about and described in terms of the relationship between the company and the branch. However, we can also consider the ordering of levels that can be described as organizational in that they constitute negotiation spaces specific to the productive organization. In the determination of the places where the capacity for self-regulation is deployed and in the arrangement of conventional norms, a certain construction and structuring of the productive organization is at stake. In this respect, positive law is the setting for a striking evolution. On the one hand, there is a diversification of the levels at which collective agreements are concluded. The establishment and the company have been joined by the group, and even the “inter-company” level. On the other hand, this diversification is accompanied, not by a material distribution of normative competences distributed between each level, but by a freedom offered to the social partners to choose the level they consider most appropriate for their negotiations by the creation of a form of fungibility of agreements. The company collective agreement becomes a generic category encompassing the establishment agreement, the company agreement in the strict sense, and the group agreement. This freedom goes as far as offering the parties the possibility of organizing the prevalence of the agreement concluded at the centralized level over the local agreement.

      Partant du constat d'une transformation profonde des logiques de la négociation transnationale dans certaines entreprises multinationales basées en Europe, cet article analyse la façon dont les accords qui en sont issus sont de nature à renforcer l'épaisseur sociale de l'entreprise mondiale. Adossés à des politiques d'entreprises, ces accords représentent des instruments de régulation sociale des filiales du groupe. Leur négociation est aussi, et peut-être avant tout, un travail conjoint de connaissance et d'exploration de l'entité sociale que forment les différentes filiales de l'entreprise mondiale. Elle en dessine ainsi la cartographie sociale. L'article analyse la portée et les limites de cette forme émergente de négociation transnationale d'entreprise.
      Based on the observation of a profound transformation of the logic of transnational negotiation in certain multinational companies based in Europe, this article analyzes the way in which the agreements that have emerged are likely to reinforce the social thickness of the global company. Backed by company policies, these agreements represent instruments of social regulation of the subsidiaries. Their negotiation is also, and perhaps above all, a joint work of knowledge and a common exploration of the social entity formed by the different subsidiaries of the global company. It thus draws its social map. The article analyzes the scope and limits of this emerging form of transnational company negotiation.

      La production cinématographique en France se caractérise par une logique de projets profondément hétérogènes en matière de moyens et de budget. À cet égard, il est remarquable que la branche se soit constituée en espace majeur de négociation des normes applicables, notamment en ce qui concerne les salaires des équipes techniques, c'est-à-dire des réalisateurs, opérateurs, décorateurs, etc. Alors même que l'orientation générale des réformes du code du travail, depuis les années 1980, a tendu à favoriser la négociation au niveau de l'entreprise afin d'accompagner les variations productives, ce niveau de négociation est déserté par le cinéma. Visant à élucider ce paradoxe, l'hypothèse de cet article tient précisément dans l'idée que le renouvellement indéfini de projets variés requiert d'établir des repères d'action généraux, dont la branche fournit le cadre. Dès lors, penser la négociation collective permettrait moins de penser l'« entreprise » comme une entité stabilisée qu'une activité productive éminemment fluide, où le droit négocié jour un rôle structurant.
      Film production in France is characterized by a logic of profoundly heterogeneous projects in terms of means and budget. In this respect, it is remarkable that the branch has become a major space for negotiating applicable standards, especially concerning the wages of technical teams, that is to say directors, operators, decorators, etc. Even though the general orientation of the reforms of the labor code since the 1980s has tended to favor negotiation at the company level, in order to accompany production variations, this level of negotiation is deserted by cinema. The hypothesis of this article, which aims to elucidate this paradox, lies precisely in the idea that the indefinite renewal of various projects requires the establishment of general reference points for action, for which the branch provides the framework. Therefore, a consideration of collective bargaining would allow us to see the “company” less as a stabilized entity than as an eminently fluid productive activity, where negotiated law plays a structuring role.
    • Stratégies des multinationales pour reconfigurer le périmètre de l'entreprise et l'aire de la négociation collective en Tasmanie - Patrice Jalette, Ruth Barton p. 89-105 accès libre avec résumé avec résumé en anglais
      Cet article montre comment deux multinationales ont utilisé le périmètre de l'entreprise et l'aire d'influence de la négociation collective pour échapper à l'influence syndicale ou la réduire. S'appuyant sur un travail de terrain s'échelonnant de 2011 à 2019 en Tasmanie, les résultats présentent diverses manières dont les firmes tirent avantage de ces stratégies de reconfiguration et font ressortir leurs limites.
      This article shows how two multinationals have used the company perimeter and the scope of influence of collective bargaining to escape or reduce union influence. Drawing on fieldwork spanning from 2011 to 2019 in Tasmania, the findings present various ways in which these firms take advantage of these reconfiguration strategies and highlight their limitations.

      Loin d'une décentralisation favorisée par diverses réformes de la négociation, il arrive fréquemment que cette dernière s'éloigne des lieux du travail. Cette situation est accompagnée d'un double processus de concentration des décisions et de filialisation / sous-traitance des activités qui pousse au constat d'une difficulté à se mobiliser et du recul des conflits collectifs dans une entreprise « fragmentée », au cours de la dernière décennie. Mais face à une organisation légale et économique de la négociation d'entreprise peu propice aux mobilisations collectives, le constat de situations conflictuelles mérite qu'on s'y attarde. En quoi ces situations conflictuelles éclairent-elles les dynamiques de négociation et, ainsi, de la structuration de l'entreprise ? Cet article s'appuie sur trois études de cas à partir d'une post-enquête REPONSE afin de montrer comment trois types de conflit – de rupture, rituel et empêché – permettent de penser l'entreprise aujourd'hui dans la diversité des configurations de négociation.
      Far from a decentralization caused by various collective bargaining reforms, it is often the case that this negotiation takes place outside of the workplace. This situation is accompanied by a double process of concentration of decisions and subsidiarization/subcontracting of activities, which has led to the observation that it is difficult to mobilize and that collective conflicts in a “fragmented” company have declined over the last decade. However, in the face of a legal and economic organization of company bargaining that is not very conducive to collective mobilization, the observation of conflictual situations deserves to be examined. How do these conflictual situations shed light on the dynamics of negotiation and, thus, of the structuring of the company? This article is based on three case studies from a REPONSE post-survey`np pagenum="108"/b in order to show how three types of conflict – rupture-based, ritual, and impeded – allow us to study the company today through the lens of the diversity of configurations of bargaining.
