Cet article propose de revenir sur la naissance d'une police moderne lors de la première monarchie constitutionnelle. À l'aune de la Garde nationale révolutionnaire, les Constituants jettent les premières bases d'une police publique. La Garde nationale est l'œuvre d'une recomposition profonde. Le contenu de sa législation recèle un foisonnement d'idées et l'essor de principes nouveaux tant sur le plan politique que dans son versant strictement juridique. Elle incarne cette phase de transition fondamentale d'une organisation de police au cœur de l'État. Sa création permet à l'Assemblée nationale constituante de concentrer au sein d'une même institution un ensemble de modifications substantielles. Sur le plan juridique, les Constituants établissent une nouvelle manière d'appréhender l'organisation de la force grâce au concept de « force publique ». Sur le plan opérationnel, les députés consacrent l'avènement d'un nouveau dispositif régalien dans le cadre du maintien de l'ordre public. À cet effet, cette organisation de police sera placée sous la tutelle d'une autorité civile. Toutefois, ce dispositif initial sera contesté du fait des événements révolutionnaires. Néanmoins, la Garde nationale offre à se voir comme une organisation aux dimensions inédites. Elle est cette force de police citoyenne qui sera placée au centre des débats de la Constituante. This article aims to return to the birth of a modern police force during the first constitutional monarchy. In the light of the Revolutionary National Guard, the Constituents lay the first foundations for a public police force. The National Guard is the work of a profound restructuring. The content of its legislation conceals an abundance of ideas and the development of new principles both politically and in its strictly legal aspect. It embodies this fundamental transitional phase of a police organization at the heart of the state. Its creation allows the National Constituent Assembly to concentrate within a single institution a set of substantial modifications. On the legal level, the Constituents establish a new way of understanding the organization of force thanks to the concept of public force. Operationally, deputies are dedicating the advent of a new sovereign system within the framework of maintaining public order. To this end, this police organization will be placed under the supervision of a civilian authority. However, this initial device will be contested because of the revolutionary events. Nevertheless, the National Guard offers to see itself as an organization with unprecedented dimensions.
