Le vice-président du Conseil d'État n'est pas membre du gouvernement. L'interrogation – ministre de la juridiction administrative ? –, outre qu'elle souligne la singularité de la fonction, permet de cerner la « puissance » de la vice-présidence. Celle-ci résulte moins des compétences juridiques qu'il détient à l'égard de la juridiction administrative que de l'autorité qu'il tire tout à la fois de la situation du Conseil d'État dans l'organisation étatique et de sa propre situation au sein de l'institution. The Vice-President of the Council of State is not a member of the government. Asking whether he should be considered as the minister of the Administrative Court helps highlight the importance of his function, and determine the “power” of the vice-presidency. This power comes less from the judicial competencies the vice-president has vis-à-vis the Administrative Court than from the authority conferred upon him by the position of the Council of State within the state structure and from his own situation within the institution.
