L'art d'écrire la loi n'a pas de loi. On ne codifie pas l'alchimie de l'écriture. Les dispositions récentes qui déparent le Code civil montrent seulement que les artistes sont rares. Mais le Code lui-même, dans sa fraîcheur originaire et la refonte des années 1964-1975, laisse voir certains des secrets de son art, varier le ton populaire et savant, s'élever à des maximes en forme d'adages, renvoyer à la jurisprudence, à la coutume, à la raison, ne dire que l'essentiel au creuset de l'écriture par article. La source est profonde. L'art d'écrire la loi est artisanal. En chaque pays, il est historique, culturel, idiomatique. C'est par leur complicité linguistique que le législateur et les citoyens s'entendent. Comme l'architecture, et non sans lien, l'écriture de la loi est la signature d'un peuple. The art of writing the law knows no law. The alchemy of writing cannot be codified. The recent provisions which have disfigured the Civil Code only tend to indicate that artists are rare. But the Code itself, in its original freshness and in the 1964-1975 version, reveals some of the secrets of its art, by mixing popular and scholarly styles, by offering maxims in the form of adages, by referring to jurisprudence, custom, reason, by limiting itself to the essential in the crucible of its articles. Its source is profound. The art of writing the law is that of a craftsman. In each country it is historical, cultural, idiomatic. It is thanks to their linguistic complicity that the legislator and the citizens understand one another.
