Les conseillers prud'hommes en audience sont des juges non professionnels qui détiennent un mandat de leur organisation syndicale ou professionnelle. Ils s'inscrivent à l'intersection du champ judiciaire, du champ syndical et du monde du travail. Si le moment de l'interrogatoire leur permet de rappeler qu'ils sont des juges comme les autres, à la recherche de la vérité, il les autorise aussi à mettre en scène leur identité de représentant syndical ou patronal et à promouvoir leur expertise du monde du travail. Articulant savoir juridique, savoir-faire syndical et connaissances de terrain, les conseillers prud'hommes montrent en acte ce qu'ils incarnent : une justice du travail rendue par des pairs. Labor as judgment and representation Prud'hommes magistrates are non professional judges who are mandated by the professional organization or the union to which they belong. They stand at the intersection of three fields: the judiciary field, the field of unions, and the field of labor. While their capacity to examine defendants in court is a reminder of the fact that they are regular judges, in search of truth, it also allows them to stage their identity as representatives of unions or employers' organizations, and to promote their expertise of labor relations. As they combine legal knowledge, a know-how acquired through unionization, and their knowledge of the field, prud'hommes magistrates embody a peer-driven form of labor justice.
