Michèle Ferrand-Picard : Médicalisation et contrôle social de l'avortement. Derrière la loi, les enjeux.
Le 17 janvier 1975, est promulguée la loi Veil, libéralisant l'avortement. L'analyse de l'élaboration du projet et des débats qui présidèrent à son vote permet la mise en évidence de la pluralité des attitudes face à l'avortement. Cette loi, expression d'un compromis entre des positions antagonistes, n'a pu être votée que grâce à l'unanimité qui s'est formée autour de sa dimension préventive. Elle obéit à deux sortes de préoccupations : sanitaires et sociales. Elle s'appuie sur un dispositif dont la gestion est confiée au corps médical. La médicalisation de l'avortement, objectif essentiel de la loi, apparaît alors à la fois comme la garantie d'une prévention sanitaire efficace et comme l'instrument d'un contrôle social de la procréation. Michèle Ferrand-Picard : Medicalization and social control ; the issues behind the law. The Veil law liberalizing abortion, was promulgated on January 17, 1975.
An analysis of the elaboration of the project and the debates which surrounded the vote reveals the plurality of attitudes regarding abortion. Insofar as the law represented a compromise between opposed positions, it would not have been passed if its preventive aspect had not met with unanimous approval. The law answers to two types of concerns, sanitary and social. It depends on mechanisms whose management is entrusted to the medical community. The medicalization of abortion which is the essential objective of the law, appears both as a guarantee of effective sanitary prevention and as an instrument for the social control of procreation.
