Cet article propose une critique de la théorie de la déviance qui se construit sur un postulat : la procédure de désignation (labeling) est une activité pratique orientée vers une certaine fin et à laquelle participe un groupe spécifique d'acteurs pris dans des circonstances sociales déterminées. L'analyse d'une situation empirique dans laquelle un même individu est le sujet de deux désignations distinctes (l'hospitalisation du « pauvre ») permet de présenter une théorie positive de la déviance, c'est-à-dire une théorie qui ne recoure ni à une explication en termes d'acquisition d'une identité sociale, ni à l'invocation d'une « réaction sociale » qui ne serait le produit d'aucune attribution de sens de la part des acteurs. Cette théorie s'échafaude sur la conception de ce « domaine de pertinence d'une désignation » qui se définit dans le cours de l'élaboration d'un jugement pratique porté sur un individu. Albert Ogien : Labeling order. Regular patients in hospital services.
The present paper proposes a critique of the theory of deviance which may be translated by the following postulate: the labeling procedure is a practical activity oriented towards a specific goal and whose participants are a specific group of actors taken from determined social circumstances. Analysis of an empirical situation in which one particular individual is the object of two distinct labelings (hospitalisation of the "poor") enables us to present a positive theory of deviance, i.e. a theory that draws its explanation neither from acquisition of a social identity nor from "social reaction" which the actors themselves would not have produced through any attribution of meaning. The author's theory is built up on the conception of that "field of relevance of labeling" defined during the course of elaborating a practical judgment of an individual.
