On présente ici la première étape d'un travail sur la vente en viager de biens immobiliers. De cette transaction inconnue et méconnue (l'absence de données autres que juridiques est à cet égard significative), deux aspects ont retenu l'attention. Sa spécificité d'une part : l'analyse des mécanismes juridiques permet de montrer qu'elle lie de façon originale la réponse à deux questions cruciales concernant les personnes âgées, à savoir logement et ressources - ce qui conduit à examiner l'intérêt d'un aménagement collectif de ce type de contrat. D'autre part, les usages sociaux qui en sont faits ainsi que les représentations qui s'y rattachent : qui ? où ? combien ? pourquoi ? au prix de quels risques ? au mépris de quels préjugés ? dans quelle logique d'échanges inter-générationnels ? Férial Drosso : Selling real estate for a life income. In view of a definition.
This represents the first stage of a study on selling real estate for a life income. As regards this type of transaction which is not well known and frequently misunderstood (this is explained by the absence of information, other than legal, on the subject), there are two points which have been accorded particular attention. On the one hand, its specificity : the analysis of legal mechanisms shows how, in an original manner, it brings together the reply to two fundamental questions concerning elderly people, which are housing and resources - this leads us to look into the need for a collective approach to this type of contract. On the other hand, the social practice involved and the representations which become part of the transaction : who ? how much ? at what risk ? disregard of which considerations ? based on which inter-generation exchange logic ?
