Résumé La Commission du droit international a adopté en 2011 en seconde lecture le texte complet du projet d'articles sur la responsabilité des organisations internationales, qui a fait l'objet de critiques parfois substantielles. Une part importante de celles-ci a trait à la méthodologie suivie (on a par exemple reproché à la CDI d'avoir suivi de trop près le régime de responsabilité applicable aux États, en ignorant par ailleurs la diversité des organisations internationales). Sur le fond, certaines modalités du régime retenu pourront poser de réelles difficultés d'application pratique ; cela concerne surtout certains aspects des règles d'attribution, la place reconnue au droit interne des organisations, ainsi que la prise en compte de l'interaction entre organisations et États membres en la matière. L'adoption du projet de la CDI est une étape importante du processus de responsabilisation des organisations internationales. Sa concrétisation demeure cependant tributaire d'une clarification des obligations primaires pesant sur les organisations dans l'ordre juridique international, ainsi que de l'instauration de mécanismes de mise en oeuvre de la responsabilité qui soient ouverts aux personnes privées.

Résumé anglais In 2011 the International Law Commission adopted on second reading the full text of the draft articles on the responsibility of international organisations, which has come in for sometimes substantial criticism. Much of the criticism relates to the methodology employed (e. g. the ILC has been faulted for following too closely the regime of liability applicable to states and ignoring the diversity of international organisations). In actual fact, some arrangements under the system may raise genuine difficulties for practical application ; this pertains above all to certain aspects of the rules of attribution, the scope recognised for the internal law of organisations, and consideration of the interaction between organisations and Member States on the subject. The adoption of the ILC draft is an important step in the process of making international organisations account for their actions. Its materialisation, though, will depend on clarification of the primary obligations weighing on organisations within the international legal order and on the establishment of mechanisms for implementing responsibility that are open to private individuals or entities.
