Marc Galanter a rédigé cette nouvelle introduction à l'occasion de la traduction de son article « Why the “Haves” Come out Ahead » en français. Il remet en perspective les conditions dans lesquelles l'article a été rédigé et publié, en insistant explicitement pour la première fois sur le rôle de son expérience indienne. M. Galanter souligne également les raisons pour lesquelles, selon lui, l'analyse reste valable aujourd'hui, et peut même être radicalisée en tenant compte des évolutions du barreau américain dans le sens d'un accroissement du poids des intérêts des grandes entreprises. Cette tendance est également renforcée par la manière dont les élites, qui profitent pourtant le plus du système judiciaire, ont réussi à le décrédibiliser et à l'affaiblir. “Haves” Ascendant Marc Galanter wrote this new introduction on the occasion of the French translation of his article “Why the ‘Haves' Come out Ahead”. He revisits the conditions under which the article was written and published, explicitly insisting on the role of his Indian experience. M. Galanter also points out the reasons why, according to him, the analysis remains valid today, and can even be radicalized, taking into account the transformation of the American bar in the direction of an increasing influence of big corporations.
