La judiciarisation croissante de l'action militaire extérieure pousse à aligner le droit des militaires sur le droit commun. La loi de programmation militaire de 2013 a tenté d'encadrer cette évolution, pour la mise en mouvement de l'action publique et plus généralement la responsabilité des militaires. Pour mettre en œuvre ce cadre juridique, la gendarmerie prévôtale a un rôle essentiel, conduisant ses investigations concernant militaires et ressortissants français en environnement hostile. The increasing judicialization of external military action is encouraging military law to fall into line with common law. The 2013 Military Planning Act attempted to put this evolution into a framework in order to make way for public proceedings and, more generally, to increase military responsibility. In order to bring this legal framework into practice, the military police will play a central role, conducting investigations involving military personnel and French citizens in hostile environments.
