Dans la « théorie de l'action » du droit à l'eau mise en œuvre dans les pays du Nord, le statut du bénéficiaire du droit à l'eau trouve une déclinaison opérationnelle dans la figure du « consommateur écoresponsable » qui lui est appliquée de facto pour maintenir son accès au service. Le décryptage de cette représentation du pauvre, qui mêle préoccupations écologiques et inégalités sociales à la lumière de l'approche par les capacités d'Amartya Sen, est intéressant. Il nous permet de réinterroger la légitimité des relations établies entre l'impératif écologique sous-jacent à l'approvisionnement en eau et les inégalités sociales qui interviennent dans l'accès à ce service public essentiel. The beneficiary of the right to water as an eco-responsible consumer : the ecological imperative set against fundamental human rights in France. In the “theory of action” relating to the right to water, as implemented in the countries of the North, the status of beneficiary of the right to water takes operational form as the “eco-consumer” which is applied to it on a de facto basis to maintain the beneficiary's access to the service. It is of interest to decrypt that representation of a poor person, a representation that blends ecological concerns and social inequality, in light of the abilities-based approach taken by A. Sen. It enables us to question afresh the legitimacy of relationships established between the ecological imperative that underlies the supply of water and social inequality that intervenes in access to that essential public service.
