La théorie du droit hollandaise commence à s'intégrer et à prendre part aux échanges internationaux en ce domaine. Cela ne signifie cependant pas que cette discipline n'a suscité jusqu'à présent aucun intérêt aux Pays-Bas. Au contraire, elle possède une longue histoire, mais une histoire provinciale, qui a empêché certaines théories tout à fait originales d'attirer l'attention internationale qu'elles auraient pu mériter. Cet article décrit les principaux courants de théorie juridique aux Pays-Bas durant ce siècle. La sociologie du droit hollandaise a connu un développement différent. Institutionnalisée depuis une quinzaine d'années seulement, sa diffusion ainsi que les échanges internationaux qu'elle suscite, connaissent un essor considérable. Les sociologues du droit ont, de plus, réussi à faire largement accepter leurs travaux par les juriste hollandais. Un certain optimisme est ainsi permis quant à l'avenir de cette discipline. Dutch legal theory is in a take-off phase to become part of and contribute to international discussions in the field. This does not mean, however, that the discipline has not found any great interest within the country up till now. On the contrary, it has a long, but rather provincial history, which prevented some quite original theories to get the international attention they might have deserved. A description is given of the main streams in Dutch legal theory of this century. Dutch sociology of law provides us with a different picture of its development. Although it became institutionalized only fifteen years ago, it has known a tremendous development in full communication and interaction with the international scene. Furthermore, sociologists of law have succeeded in gaining a wide spread acceptance for their work among Dutch lawyers. This is the reason why optimism about the future of the discipline is justified. A survey of recent and ongoing research is given. Source : Éditeur (via Persée) |
