| Résumé |
La place du chercheur en sciences sociales dans le processus judiciaire apparaît problématique. Tel est le constat qui a justifié la tenue d'une table ronde dont les principaux éléments sont restitués dans cet article. En s'interrogeant sur l'impact du témoignage historique sur la Justice, en proposant une analyse critique de l'expertise dans le cadre judiciaire, en soulignant combien « le concept d'action publique est étranger à la justice », les participants à cette table ronde font apparaître les incompatibilités entre la logique judiciaire et celle des sciences sociales en les situant sur plusieurs plans : le statut problématique de l'expertise tient précisément à sa position à la croisée des deux logiques ; aux approches scientifiques et judiciaires, largement antagonistes, le prétoire laisse libre cours à un autre usage des faits sociaux (et du passé) de nature mémorielle. The Social Scientist as Part of the Trial.
The position of the social scientist in the judicial procedure appears problematic. Such a comment justifies the convening of a round table of which the principal elements are reported in this article. By questioning the impact of the historical testimony in court, proposing a critical analysis of expert evidence in the judicial setting, and highlighting how « the concept of public policy is foreign to justice », the participants of this round table reveal the incompatibilities existing between judicial logic and that of the social sciences on several fronts. The problematic status of expert evidence depends precisely on its position at the intersection of two opposing logics : the scientific and judicial approaches.
