L'article propose une synthèse critique de travaux publiés sur l'épuration et la réintégration des magistrats allemands ayant exercé leurs fonctions sous le régime nazi. Il traite de la période entre le début de la dénazification en 1945 jusqu'en 1968, date à laquelle la plupart des magistrats actifs sous le nazisme prennent leur retraite. À travers les différentes étapes d'une dénazification administrative et juridique, l'article cherche à saisir la nature d'une « renazification » dénoncée par les institutions judiciaires ouest-allemandes. Contrairement à l'Allemagne de l'Est où la magistrature est purgée minutieusement sans réintégration de ceux qui en ont été écartés, l'Allemagne occidentale connaît un retour massif des magistrats compromis. Si ces derniers ne s'opposent pas au développement d'un système judiciaire démocratique, on constate un manque de prise de conscience de leur responsabilité sous le régime nazi. The article presents a critical survey of publications on the purge and reintegration of German judges and prosecutors who had been in office during the Nazi regime. The study covers the period between the beginning of the denazifica
tion process, in 1945, and 1968, by when most of the judges and prosecutors active under the Nazi reign had retired. By analyzing the various stages of the administrative and penal denazification process the article attempts to shed some light on the nature of the denounced “renazification” of the judicial system in West Germany. In contrast to East Germany, where judges and prosecutors were meticulously scrutinized without the reintegration of the purged, Western Germany saw a massive return of the compromised in the legal system. If these judges and prosecutors did not undermine the development of a democratic legal system they refused to accept their responsibilities under the Nazi regime. Source : Éditeur (via Cairn.info) |
