À la suite du renouvellement des études sur la justice d'Ancien Régime, l'article propose une analyse en détail d'un crime de grand chemin et de son traitement par la maréchaussée, la principale force de police de la monarchie dans le Lyonnais des années 1720. Il se propose, à travers un cas d'étude, d'illustrer un aspect particulier de la justice d'Ancien Régime : la fragmentation des juridictions, l'instabilité de leurs hiérarchies et de leurs concurrences, ainsi que l'éventail des possibles que cela ouvre pour les acteurs. Il souligne l'importance de prendre en compte dans l'analyse l'environnement institutionnel, le territoire et les justiciables, dans une démarche attentive à ne réifier ni les juridictions ni les agents de ces justices. Situated in the continuity of renewed academic interest in the Ancien Régime legal system, this article offers a detailed analysis of a crime on the grand chemin (highway) and its handling by the maréchaussée, the monarchy's main body for policing and justice around Lyon in the 1720s. It uses a case study to illustrate a particular aspect of the legal system of the Ancien Régime - splintered jurisdictions, their unstable hierarchies, and the competition between them - as well as the range of possibilities that they offered to actors. It highlights the importance of accounting for the institutional environment, territorial zones, and answerable persons in the analysis, in an undertaking that carefully avoids reification of either jurisdictions or the agents of these legal systems.
