L'Office parlementaire d'évaluation des choix scientifiques et technologiques (OPECST), organe spécialisé du Parlement chargé depuis 1983 d'anticiper les besoins d'adaptation du cadre législatif et réglementaire face aux évolutions scientifiques et technologiques, se trouve en position privilégiée pour analyser les freins à l'innovation au travers de ses différentes études, et encore récemment à l'occasion de l'évaluation de la stratégie nationale de recherche qui lui a été confiée par la loi du 22 juillet 2013 sur l'enseignement supérieur et la recherche. Ces analyses conduisent pour l'essentiel à la nécessité d'instituer un principe législatif d'innovation, permettant de mieux protéger celle-ci contre les interprétations déséquilibrées du principe constitutionnel de précaution en vigueur depuis 2005. The Parliamentary Office for Scientific and Technological Assessment (OPECST), a specialized body of the Parliament, has, since 1983, been in charge of anticipating needs and adapting the legislative and regulatory frameworks to scientific and technological developments. It is in a unique position to analyze the obstacles innovation faces through its different studies, and most recently on the occasion of the assessment of the national research strategy that has been entrusted to the OPESCT by the law of July 22nd, 2013 on higher education and research. These analyses conclude mainly to the need for establishing a legislative principle of innovation, in order to better protect innovation against unbalanced interpretations of the constitutional principle of precaution, which has been in force since 2005.
