| Résumé | La transformation progressive de la Belgique unitaire en État fédéral a entraîné des modifications importantes dans le secteur des relations internationales. L'article analyse, d'une part, la capacité contractuelle internationale reconnue par le droit interne aux communautés et aux régions belges. Il met également en évidence les techniques d'association des entités internes au processus déformation du droit européen (information continue, présence active au Conseil des ministres, ...). D'autre part, il examine dans quelle mesure l'État a obtenu la possibilité concrète de veiller à l'exécution interne des règles de droit international par le double canal d'un pouvoir de substitution temporaire à l'entité fédérée défaillante et d'une faculté de recourir à la contrainte fédérale. | |
| Résumé anglais | The transformation of the Unitarian Belgium into a federal State results in some important amendments concerning the external relations. This article shows, at the one hand, how the belgian Communities and regions have now, following internai Law, a real Treaty making power. It indicates aswell the technics of association of the internai entities in the European Law making process (continuous information, participation in the Council, ...). At the other hand, this paper examines in which measure the belgian State has now a real and accurate possibility of granting the internai application of international and European Law, throughout a substitution power and the federal strengthening. | |
