| Résumé |
La valorisation des ressources humaines dans les services publics, qui procède de la démarche de modernisation de l'Administration, tend à responsabiliser les agents administratifs ; elle intervient dans une administration déconcentrée au niveau départemental depuis 1964.
La politique de valorisation des ressources humaines mise en chantier en 1991 au ministère de la Justice bouleverse des équilibres institutionnels et porte atteinte à la notion d'autorité judiciaire : concentration des pouvoirs administratifs et juridictionnels entre les mains des représentants départementaux du ministère de la Justice, modification du statut des magistrats, augmentation de l'influence de l'autorité administrative générale, harmonisation des circonscriptions judiciaires avec les circonscriptions administratives.
La départementalisation judiciaire correspond davantage à une démarche hiérarchique et centralisatrice traditionnelle qu'à une démarche logique et scientifique de modernisation. Source : Éditeur (via Persée) |

The appreciation of human resources en public services originates from an approach to modernization. This approach was initiated in 1964 in a decentralized administration at departmental level and tended to give some responsabilities to the administrative agents.
The policy of valorizing human resources adopted in 1991 by the Ministry of Justice is disrupting institutional balances and affecting the notion of judicial authority : concentration of the administrative and juridictional powers in the hands of the departmental representatives of the Ministry of Justice ; modification of the status of the judges ; increasing influence of the general administrative authority ; harmonisation between the judicial and administrative districts.
The judicial «departmentalisation » is traditionally a more official and centralized approach to modernization than a logical and scientific one. Source : Éditeur (via Persée) |
