La protection que l'administration doit à ses agents a été récemment renforcée et le champ de ses bénéficiaires a été étendu. Cet article présente une synthèse de ces évolutions tout en adoptant une démarche critique. Il met en exergue certaines imperfections, comme le fait de continuer d'exclure la protection aux agents de droit privé alors que le régime de protection a vocation à protéger le service public pour le compte duquel chaque agent travaille. Recent evolutions of the protection granted to the French civil servants in the discharge of their official duties – The protection granted to the French civil servants in the discharge of their official duties by the administration has been reinforced recently. The scope of its beneficiaries has also been extended. This article presents a synthesis of these developments. It points at the shortcomings of the reform. The main being that public agents under private contract are still excluded from protection, whereas the guarantees granted aim primarily at protection of the public service; the running of which the public agents under private contract contribute alike.
