‪The study of Antiquity and the Middle Ages reveals commons which differ from those usually presented and which are characterised by the appropriation of settlers' land, territorial inequality, forms of exclusivity, immunity, and conditional land concessions to groups of occupants, peasants and settlers. While theories about access can explain the economic function of these commons, understanding their establishment and their profoundly inequitable legal and social functioning requires the prism of agrarian law. A close examination of what those commons constituted is therefore useful before they are included in a story and presented in reference to the changing concept of property.‪
