L'action militaire est la conséquence d'une décision politique, singulière dans son objet et ses enjeux. Elle est le résultat d'un processus décisionnel complexe où interviennent de nombreux acteurs, civils et militaires. La judiciarisation des opérations, qui cherche à établir les responsabilités individuelles des acteurs militaires, peut conduire à distendre le lien de confiance sur lequel repose l'engagement libre, conscient et responsable des soldats qui risquent leur vie au combat au nom de l'État et de la Nation. Military action is the consequence of a political decision, unique in its objective and what is at stake. It is the result of a complex decision-making process that involves the input of numerous players, both civil and military. The judiciarisation of operations, that attempts to establish the individual responsibilities of the military players, may lead to a stretching of the bond of confidence on which depends the free, conscious and responsible commitment of the soldiers who risk their lives in combat in the name of the State and the Nation.
