Plus qu'un phénomène nouveau, la judiciarisation est avant tout un phénomène médiatique. À condition qu'elle soit bien appréhendée, c'est-à-dire connue et maîtrisée, l'intrusion du monde judiciaire dans la sphère militaire n'est ni une menace ni un frein à l'action, mais une protection. La tactique consiste à la dédramatiser tout en continuant à se protéger par la connaissance des protections accordées, par le développement des liens avec le monde juridique et par les familles des soldats, par l'application de la notion de risque raisonné et par l'attaque. Not just new, judiciarisation is above all a media phenomenon. Provided it is well understood, that is to say, known and mastered, the intrusion of the legal world into the military sphere is neither a menace nor a brake on action, but a protection. The tactic consists of playing it down, whilst continuing to protect oneself with the knowledge of the protection afforded, by the development of links with the legal world and by soldiers' families, by the application of the concept of reasonable risk and by attack.
