Les projets d'implantations de récifs artificiels se multiplient depuis plusieurs années sur le littoral français. Si l'immersion de ces récifs est encadrée par une convention régionale, leur développement ne s'est pas accompagné de la création d'outils juridiques permettant l'encadrement et la gestion de ce type de structures. Les porteurs de projets comme les gestionnaires du domaine public maritime se sont alors interrogés sur le statut qu'il convenait d'adopter pour les récifs artificiels. Quel est, notamment, le titre domanial le plus approprié à ce type d'occupation ? Plus que la concession d'utilisation du domaine public en dehors des ports, l'autorisation d'exploitation de cultures marines, objet juridique hybride, à la fois autorisation d'exploitation et titre d'occupation du domaine public maritime, apparaît comme particulièrement adaptée à la nature des récifs artificiels comme aux modes de gestion qui y sont associés. During these last years projects to build artificial reefs along the French coast have been increasing. Though the immersion of such reefs is regulated by a regional convention, their development has not been followed by the creation of legal tools adapted to the regulation and management of this type of structures. Operators and managers of the public maritime domain have been looking for an adequate legal status for these reefs. What, in particular, would be the property rights most adapted to this type of occupation ? Rather than the concession which allows the use of the public domain outside ports, the legal System applying to aquaculture, being at the same time an operating permit and a right to use the public domain would seem particularly well adapted the nature and management of artificial reefs.
