L'implication des entités privées dans la lutte contre les changements climatiques est un fait bien acquis. Elle est à l'origine d'une activité normative intense et diversifiée. Cette activité se manifeste notamment par la production de certaines normes climatiques qui, outre leur origine privée, possèdent aussi une dimension internationale, en raison de la déterritorialisation de leur champ d'application. Ce constat invite alors à s'interroger sur l'existence d'un éventuel droit transnational des changements climatiques qui évoluerait en marge du droit national et international des changements climatiques. Prenant appui sur les réflexions qui ont été menées à propos du droit transnational dans d'autres domaines de réglementation, cette étude entend ainsi apporter quelques éléments de réponse au sujet de la possible existence d'un droit transnational des changements climatiques. Private entities engagement in the battle against climate change is a well-established fact, and a source of intense and diversified normative activity. A certain type of climate rules has thus arisen, with a private origin and an international scope, as they transcend the borders of existing territories. In this context, one could wonder about the possible existence of a transnational climate change law, as a relatively autonomous body of law, which would exist at the margins of international and national climate change law. Building on the discussions that have been conducted about the transnational law in other areas of regulations, this study intends to provide answers about the possible existence of a transnational climate change law.
