| Résumé |
Le domaine public maritime naturel est délimité, côté terre, par un critère physique : le critère du plus haut flot. Évolutif, ce critère physique emporte comme conséquence la domanialité publique des terres englouties par la mer suite au phénomène d'érosion ; et de facto une dépossession des propriétaires victimes d'érosion côtière. Face à cette dépossession, le propriétaire ne dispose que de faibles garanties car il ne peut ni figer la délimitation du domaine public maritime naturel ni obtenir une indemnisation pour expropriation de fait de son terrain. En effet, le législateur ne s'est pas réellement emparé de la problématique et le juge administratif, par une interprétation accommodante de la théorie du caractère « naturel » du domaine public maritime, réduit drastiquement toute velléité d'obtenir une indemnisation. The maritime public domain is delimited on the land side by a physical criteria: the criteria of the "highest flow". Evolving, this criteria has for consequence to include in the public domain lands which were covered by sea because of erosion; this leads de facto to the deprivation of owners who are victims by the coastal erosion. Then, the owner has limited safeguard since he cannot fix the delimitation of the natural maritime public domain, neither claim for compensation grounded on expropriation. Indeed, the legislator has not really dealt with this issue. In addition, the administrative judge opted for a compliant interpretation of the so-called theory of the "natural" dimension of the maritime public domain, which reduced any possibility to be granted with compensation.
