Cette contribution a pour objet de montrer la relation ambivalente entre l'autorité du juge et son pouvoir d'interprétation. Bien qu'inhérent à la fonction de juger, le pouvoir d'interpréter la loi a pendant longtemps été dénié au juge français. La construction de son autorité s'est d'abord construite sur une conception oraculaire de son interprétation. Aujourd'hui, cette conception est remise en cause au profit d'une approche légitimante qui implique d'enrichir la motivation des décisions pour en renforcer l'autorité persuasive. The aim of this contribution is to demonstrate the ambivalent relationship that exists between the judge's authority and his or her interpretive powers. Although inherent in the role of the judge, the power to interpret the law was long denied to the French judge. The judge's authority was originally constructed on an oracular conception of its interpretation. Today, this conception is being challenged by a legitimising approach that involves providing more detailed explanations of rulings in order to reinforce their persuasive authority.
