Au-delà de la justice qui découle de l'application de la loi, l'acte de juger produit un sentiment de justice au travers de l'interprétation que le juge donne au nexus de la violence formée au procès : violence des actes à juger, violence de la sentence commandée par l'acte de juger, violence sociale que le procès peut apaiser ou au contraire réveiller. La prudence du juge consiste dans cette disposition herméneutique à l'égard du nexus de la violence. Beyond the form of justice that stems from application of the law, the act of judging produces a feeling of justice through the interpretation the judge gives to the nexus of violence formed at the trial: violence of the acts to be judged, violence of the sentence that results from the act of judging, social violence that the trial may ease or, on the contrary, aggravate. The prudence of the judge consists in this hermeneutic disposition with regard to the nexus of violence.
